Acceptable Use Policy

This policy forms part of, and is governed by the NovoLink Terms of Service, as applicable. Terms used herein but not otherwise defined shall have the meanings ascribed to them in the Terms of Service.
Use of the Service is subject to and conditioned upon compliance with the NovoLink Acceptable Use Policy (“AUP”). This AUP is incorporated into and made part of any Agreement with NovoLink.
The AUP applies to all NovoLink Service.
1 Use of service.
Customer agrees to use NovoLink Service in a manner that is consistent with all applicable laws and regulations. Service may not be used for any purpose that is deemed by NovoLink to be inappropriate and/or improper. Use of the Service and the Equipment as follows is expressly prohibited.
1.1 Inappropriate service use.
Customer agrees to not use the Service in a manner inconsistent with its intended purpose, including, robocalling, or sending abusive, unsolicited, or otherwise automated communications.
1.2 Device tampering.
Customer agrees to not tamper with, reprogram, alter or otherwise modify any device used with the Service to circumvent the NovoLink Terms of Service or applicable regulations and laws. Custom also agrees to not change the electronic serial number or equipment identifier, if any, of the Equipment, or to perform a factory reset of the Equipment, without prior authorization from NovoLink.
1.3 Fraud, Service and/or device theft.
Customer agrees to notify NovoLink as soon as Customer becomes aware of any fraudulent or unauthorized use of its Service or theft of Equipment. NovoLink is not responsible for damages resulting from the fraudulent or unauthorized use of Customer service and payment of all charges related to the fraudulent or unauthorized use of Customer service shall be the responsibility of Customer.
1.4 Falsifying user or information.
Customer will not falsify or provide misleading information including but not limited to user information, customer information, intent for use of Services, or other identifying information provided to NovoLink or to other users of the Service.
1.5 Long duration calls.
Engaging in long duration calls (defined as calls to the same number in excess of four (4) continuous or cumulative hours within a 24 hour period) and/or calls placed to specific numbers / destinations for the purpose of generating charges or fees for or with a third party.
2 Resale of service.
Resale of the Service is prohibited. Customer may not sell, resell, sublicense, assign, license, or sublicense the Service or any component thereof unless Customer is part of a NovoLink service provider or carrier program.
3 Minute usage plans.
Reasonable and acceptable business usage standards apply to usage plans, including those labelled “unlimited” usage which can include local and long-distance calls to the U.S. (Hawaii and Alaska included) and to Canada. Any usage that exceeds 3000 minutes per user within any monthly billing period shall be deemed excessive and outside of reasonable and acceptable business usage. NovoLink reserves the right to bill Customer for usage in excess of established acceptable usage at current NovoLink rates. NovoLink may alter Customer’s service to a metered plan or terminate service if exceedance of acceptable usage standards continues.
